(“SEKKISEI”, “we”, “us” or “our”), and this Privacy Policy (“Privacy Policy”) will tell you the way we handle information learned about you from your interactions with us, including visits to our website available at https://sekkiseibeauty.com (the “Site”).

When you interact with us, including when you access or use the Site or submit information to or through the Site, you accept the terms of this Privacy Policy and our Terms & Conditions and consent to our collection, use, disclosure and retention of your information as described in this Privacy Policy.

We refer to those third-party websites, applications, and platforms here generally as "Social Media”. When you post, tag, comment, message, or otherwise transmit content to, on, or through Social Media account(s) or page(s) controlled and operated by us (our “Social Media Pages”), we will collect the information contained in your post, including any text, photograph or video (which may also reveal your gender and racial or ethnic origin), or other data or information provided through that post, message, or submission. 

        • When you engage with our content on or through Social Media, we may have access to certain information in your profile with that Social Media if you have enabled your profile details to be shared. This may include your name, e-mail address, photo, gender, birthday, location, an ID associated with the Social Media profile, user files, photos and videos, list of friends or connections, people you follow and who follow you, posts, “likes,” and more. 

        • Please note that if you choose to post, tag, comment, or otherwise transmit content to, on, or through Social Media Pages, any information you post may be visible to any other visitors to that Social Media Page. We are not responsible for any Personal Information you include in such posts or for any use of such information by any other visitor to the Social Media Page.

        • We do not control and will not be liable for the data practices of third-party Social Media. You should read the privacy policies and terms of use of the Social Media you use and check your privacy settings on those Social Media to make sure you are permitting those platforms to share only the information that you want to share.

      • Payment information (e.g., credit card number, billing address, card expiration date, security code)

      • Details of your specific orders and transactions with us, including the products you’ve purchased and your shopping/consuming histories 

      • Geolocation through your IP address

      • Any other information you may provide to us when you contact us.

      This information is collected when you:

      • contact us.

      • purchase our products.

      • register for an account with us for our rewards program or, if you are a content creator, influencer or blogger, when you create an account to be a part of our Affiliate Program.

      • complete a form on the Site.

      • sign up to participate in our sweepstakes.

      • subscribe to our mailing list or consent to participate in any of our text messaging campaigns. Please see our Text Message Terms and Privacy Policy for more information on our text messaging practices.

      • post a review on the Site or post, tag, comment, message, or otherwise transmit content to, on, or through any of our Social Media Pages. 

      We may combine Personal Information with other information we have collected from you. We may also combine your Personal Information with information we receive about you from other sources, such as publicly available information sources and our service providers.

    3. Information Collected from Use of the Site

      Through your use of the Site, we may also gather information about your use of the Site that may not identify you directly but may identify your computer or device. Generally, this information is collected through what we refer to herein as “Traffic Data.” We may collect and store such Traffic Data automatically whenever you interact with the Site. For example, we may collect your IP address, operating system type, computer/device type, browser type, language preference, access time and date, Internet Service Provider, referring website addresses, sear queries, browsing history, geographic location (through your IP address), Mac address, advertising ID, IDFA and other technical information such as protocol status and substatus, bytes sent and received and server information. We may collect information regarding user traffic patterns and Site usage, including your click-stream and your interaction with our Site and advertisements. We may collect similar information from e-mails you receive from us that can help us track which e-mails are opened and which links are clicked by recipients. This Traffic Data is used to operate, analyze and improve the Site, to provide you with a better experience on the Site, and to show you promotional offers tailored to you (both on the Site and on third party sites), and technical troubleshooting.

      We may also receive similar data from our business partners, including online advertising networks, and from Social Media, such as Facebook, Instagram and TikTok subject to your registration and privacy settings with such Social Media.

    4. Cookies and Other Passive Collection Technologies

      As you navigate the Site, certain Traffic Data may be passively collected, meaning it is gathered without your actively providing it. This is done using the following technologies in the following ways:

      IP Address: Your IP Address is a number that is automatically assigned to the computer that you are using by your Internet Service Provider. An IP Address is identified and logged automatically in our server log files whenever a user visits the Site, along with the time of the visit and the page(s) that were visited. Collecting IP Addresses is standard practice on the Internet and is done automatically by many online service providers, including website operators. We use IP Addresses for purposes such as calculating Site usage levels, determining in what geographic regions our visitors are located, helping diagnose server problems, and administering the Site.

      Through your browser: Certain information is collected by most browsers, such as your Media Access Control (MAC) address, computer type and operating system type, and browser type. Just as IP addresses, we may use this information to enhance our Site and user experience.

      Through your device: If you access the Site through a mobile device or other network-connected product, certain information may be collected about that device, including your device type, network service provider, and other identifiers. We may collect unique device identifiers (such as IDFA) associated with the devices you use to access the Site.

      Using cookies: Like many companies, our Site may use “cookies” to help make sure the Site is meeting the needs of its users and to help us make improvements. Cookies are bits of text that are placed on your computer/device when you visit certain websites or online services. We may use cookies set by us on the Site to tell us, for example, whether you have visited us before or if you are a new visitor.       Using Monitoring Tools: Cookies are not the only way to recognize or track visitors to a website. We may use other, similar technologies from time to time, like web beacons, pixel tags, clear GIFs, Flash Shared Objects, and similar technologies to better tailor the Site to provide a better service and to deliver offers that we think may be of interest to you.       Interest-Based Advertising: Our Site uses interest-based advertising, which is where certain information about your internet viewing behaviors or practices, over periods of time and involving websites or applications which are not our Site, may be used for the purpose of choosing advertising to display to you on our Site and on other third-party websites or platforms. We have enabled Google Analytics advertising features such as remarketing with Google Analytics, Google Display Network Impression Reporting, Google Analytics Demographics and Interest Reporting, and integrated services that allow Google Analytics to use cookies, device identifiers, and other tracking mechanisms to collect data for advertising purposes and to market our products and services to you through advertisements on other websites based on your past interactions with our Site.       Opting-out does not mean that you will stop receiving advertisements from us. It means that you still stop receiving advertisements from us that have been targeted to you based on your visits and browsing activity across websites over time.

      Social Media Plug-Ins: We use social media plug-ins from Social Media like Meta (e.g., Facebook and Instagram) and TikTok, which may be labeled on our Site with the well-known symbols of the respective Social Media. If you interact with these plug-ins, your activity on the Site may also be made available to those Social Media. In order to understand how those Social Media use and disclose your Personal Information, please review the privacy policies available on the respective websites of those Social Media.

      Do Not Track Signals: Our Site currently does not respond to “Do Not Track” (DNT) signals. Do Not Track is a privacy preference that you can set in your web browser to indicate that you do not want certain information about your webpage visits collected across websites when you have not interacted with that service on the page.   2. How We Use the Information We Collect about You

    We use the information we collect for the purposes described in this Privacy Policy and as otherwise described to you at the point of collection. Generally, we use the information you provide for the reason for which it was provided. For example, if you contact us by e-mail, we will use the Personal Information you provide to answer your question or resolve your problem and will respond to the e-mail address from which the contact came. We may also use your Personal Information for the following purposes:

    • Requests and Inquiries: We may use your Personal Information to process, evaluate, and respond to your requests and inquiries. For instance, if you provide us with information to register an account with us, we will use the information you provide to create and manage your account. If you provide us with Personal Information to participate in a promotion, we may use your information to administer your participation.     • Rewards Program and Sweepstakes: If you participate in our rewards program or sweepstakes, we may use Personal Information about you and your orders and transactions with us to administer and manage the rewards program or our sweepstakes, to communicate with you about offers that may be of interest to you, and to track and process your rewards.

    • Legal Requirements, Industry Standards, and Contractual Obligations: We may use your Personal Information as we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Privacy Policy and our Terms & Conditions; (v) to protect our operations; (vi) to protect our rights, privacy, safety or property, and/or that of you or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.

    We may use de-identified Personal Information or aggregate information that does not identify an individual without restriction, and we may share such information with third parties.

  3. With Whom We Disclose Your Information

    We may disclose your Personal Information as described in this Privacy Policy or as otherwise described to you at the point of collection.

    • Parent Company, Subsidiaries, Affiliates or Other Related Companies: We may share your Personal Information with our parent company, subsidiaries, affiliates or other related companies for our internal business purposes. Our affiliates will be bound to use that Personal Information in accordance with this Privacy Policy.

    • Agents, Consultants, Vendors, and Service Providers: We may share your Personal Information with individuals or companies that we engage to provide services to us, such as website hosting services, services to provide certain functionalities on the Site, payment processing and administering our sweepstakes.

    • Third Party Business Partners: Certain programs, applications, or services available through the Site are made available through third party business partners. Although our treatment of your Personal Information that is provided to participate in such a third-party program, application, or service is governed by this Privacy Policy, the treatment of your Personal Information by these third-party business partners will be governed by the privacy policies of such third parties.

    • Other Online Visitors and Users: If you submit a Social Media post, the information of that submission and its contents may be shared with other visitors or users of that Social Media. Information that you share in that manner is considered publicly available information and not protected as Personal Information under this Privacy Policy. Please carefully review the privacy practices of any third-party website or online service you may use to submit such posts.

    • Business Transfers: We may transfer your Personal Information in the event of a business sale, merger, consolidation, change in control, transfer of substantial assets, bankruptcy, liquidation, or reorganization. We may also disclose your Personal Information in the course of due diligence of such a transaction. You acknowledge and agree that any successor to or acquirer of our business or our assets will continue to have the right to use your Personal Information and other information. Whether the recipient of your Personal Information in these cases will handle your Personal Information pursuant to this Privacy Policy will depend on the applicable law and other factors.

    • Legal Requirements: We use and disclose Personal Information as we believe to be necessary or appropriate: (i) under applicable law, including laws outside your country of residence; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities, including public and government authorities outside your country of residence; (iv) to enforce this Privacy Policy and our Terms & Conditions; (v) to protect our operations or those of any of our parent company, subsidiaries, affiliates or other related companies; (vi) to protect our rights, privacy, safety, or property, and/or that of our parent company, subsidiaries, affiliates or other related companies, you, or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.

    • Passively Collected Information: We may share Traffic Data as described in Section 1.c (“Cookies and Other Passive Collection Technologies”) of this Privacy Policy.

  4. Your Rights and Choices

    1. Accessing and Correcting Your Personal Information

      You have the right to request access to and to correct the Personal Information that we hold about you.

      If you have an account with us, you can review and change your Personal Information by logging into your account and visiting your account profile page.

      If you want to review, verify, correct, or withdraw consent to the use of your Personal Information, you may also send us an e-mail at service@sekkiseibeauty.com to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

      We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some or all of the Personal Information that we hold about you, or we may have destroyed, erased, or made your Personal Information anonymous in accordance with our record retention obligations and practices. If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

    2. Opt Out from Direct Electronic Communications

      Where it is in accordance with your preferences, we may send you direct electronic communications, such as through e-mail or text message. You may “opt out” of receiving these electronic communications by following the instructions in the message that you receive, or by sending an e-mail to us at service@sekkiseibeauty.com indicating which communications you no longer wish to receive. Please note that if you opt out of receiving promotional messages from us, this does not impact other transactional and administrative messages which you will continue to receive (such as e-mails relating to billing and payment information or changes to this Privacy Policy).       You may also access or modify your e-mail address and shipping address through your account.

    3. Opt Out from Tracking Technologies

      You can opt out from certain tracking technology-related processing as described in Section 1.c (“Cookies and Other Passive Collection Technologies”) of this Privacy Policy.

    4. Withdrawing Consent

      Where you have provided your consent to the processing of your Personal Information, you may have the legal right to withdraw your consent under certain circumstances. Please note that if you withdraw your consent we may not be able to provide you with a particular product or service. We will explain the impact to you at the time to help you with your decision. 

  5. Cross Border Transfers

    We may process, store, and transfer your Personal Information in and to a foreign country, with different privacy laws that may or may not be as comprehensive as the laws of your jurisdiction. In these circumstances, the governments, courts, law enforcement, or regulatory agencies of that country may be able to obtain access to your personal information through the laws of the foreign country. We will only transmit Personal Information outside of your jurisdiction through the use of appropriate safeguards.

    Your use of the Site or provision of your Personal Information constitutes your consent to the processing, storage, and transferring of your Personal Information to countries outside of your jurisdiction, such as the U.S.

  6. Nevada Residents

    Under Nevada law, we do not sell your Personal Information. However, if you are a Nevada resident, you may submit a request that we not sell any personal information we have collected about you by contacting us at service@sekkiseibeauty.com.

  7. California Residents

    Under California Civil Code Section 1798.83, also known as California’s “Shine the Light” law, California residents with whom we have an established business relationship are entitled to request and receive, free of charge, once per calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses in the previous calendar year. Please be aware that not all information sharing is covered by the “Shine the Light” law requirements and only information on covered sharing will be included in our response.

  8. Nebraska and Texas Residents

    The categories of Personal Information we process about you are set forth in Section 1 (“Information We Collect About You”). The purposes for processing such Personal Information are set forth in Section 2 (How We Use the Information We Collect about You). We disclose the Personal Information we process about you with the third parties set forth in Section 3 (With Whom We Disclose Your Information).

    As a Nebraska or Texas resident, you have the rights to:

    • Confirm whether or not we are processing your Personal Information and access such Personal Information; 

    • Correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and the purposes of the processing of your Personal Information; 

    • Delete Personal Information provided by or obtained about you; 

    • Obtain a copy of your Personal Information we process, in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance, where the processing is carried out by automated means; and 

    • Opt out of the processing of Personal Information for purposes of:

      • Targeted advertising;

      • The sale of Personal Information; or 

      • Profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

    The verifiable consumer request must:

    • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information; and

    We reserve the right to verify your identity in connection with any requests regarding Personal Information to help ensure that we provide the information we maintain to the individuals to whom it pertains and allow only those individuals to exercise rights with respect to that information. We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. 

    In the event we deny your request, you may appeal our denial by contacting us in the same manner by which you submitted your request. 

    We process your Personal Information for the purposes of targeted advertising, and under Nebraska and Texas laws, our processing may qualify as a “sale”. We share the information set forth in Section 1.c (“Cookies and Other Passive Collection Technologies”) with our third-party website analytics service providers and digital advertising partners. To opt-out of such sharing of information with our third-party website analytics service providers and digital advertising partners, please click on the hyperlink entitled “Your Privacy Choices” set forth at the footer of the Site. 

    If you are an authorized agent making a request to opt-out on behalf of a consumer, we may require and request that you provide us with written permission signed by the consumer to verify that you are authorized to make such request.

  9. Children

    No parts of our Site are directed to or designed to attract anyone under the age of 13. We do not knowingly collect Personal Information through the Site from children under the age of 13. We reserve the right to delete any information identified as having been provided through the Site from children under the age of 13.

  10. Security

    We take what we believe to be reasonable steps to protect the Personal Information collected by us from loss, misuse, unauthorized use, access, inadvertent disclosure, alteration, and destruction. However, no network, server, database, or Internet or e-mail transmission is ever fully secure, error-free, or “hacker proof.” Therefore, you should take special care in deciding what information you provide to us. It is your responsibility to protect the security of your login information.

    We generally retain Personal Information for as long as it is necessary to fulfill the purpose for which it was collected, or for longer when required by applicable law. To dispose of Personal Information, we may anonymize it, delete it, or take other appropriate steps. Even if we delete your Personal Information, it may persist on backup or archival media for an additional period of time for legal, tax, or regulatory reasons, or for legitimate and lawful business purposes.

If you access a third-party website or online service from a link on the Site, any information you disclose on that website or online service is not subject to this Privacy Policy. It is possible that these links may be used by third parties or others to collect personal or other information about you. SEKKISEI is not responsible for the privacy practices of such websites, advertisers, or third parties or the content of such websites or online services. SEKKISEI does not control these third parties’ use of cookies, collection of information, or how they manage such information. It is solely your obligation to review and understand the privacy practices and policies of these other websites and/or online services, advertisers and any third parties.

  13. Updates and Changes to Our Privacy Policy

    The business and operations of SEKKISEI may change from time to time. As a result, it may at times be necessary for us to make changes to this Privacy Policy to reflect changes in the law, our data handling practices, or the features of our services or Site. We reserve the right, in our sole discretion, to update or modify this Privacy Policy at any time. Modifications to this Privacy Policy will be posted on the Site and the new Last Updated date will be displayed at the top of this Privacy Policy. In certain circumstances, SEKKISEI may, but need not, provide you with additional notice of such modifications, such as via e-mail. Modifications will be effective 30 days following the Last Updated, or such other date as communicated in any other notice to you. Where required by applicable law, we will apply changes only with your consent.

    Please review this Privacy Policy periodically, and especially before you provide any Personal Information. This Privacy Policy was updated on the date indicated above. Your continued participation in the use of our Site, programs, services, and purchase of our products following the effectiveness of any modifications to this Privacy Policy constitutes your acceptance of those modifications. If any modification to this Privacy Policy is not acceptable to you, you should cease purchasing our products or accessing, browsing, and otherwise utilizing the Site, our programs and services.
